If an Indian (American citizen) male went to india for an engagement and signed a marriage certificate but is not having the wedding ceremony until next may 2013, is he able to break off this engagement if he signed a marriage certificate?

Marriage certificate is proof of marriage, if you have signed it in the Registrar of Marriages office and the Marriage Certificate has been issued, it basically means your marriage has been done, now whether it was fraud or cheating, you now need to prove that there was no marriage ceremonies done only engagement of marriage conducted and you unwarily signed some documents that were application for marriage registration and marriage certificate that is now binding you in the matrimonial knot.

Now you break the engagement or not you are bound by the marriage certificate and pay for this mistake of not consulting a honest lawyer before putting signatures on the documents relating to the marriage.

I know this common practise going on in States of Gujarat, Punjab etc. where NRIs are being allured by local Indian to indulge in such fraud marriages and government officials like Registrar of Marriages of the district too are involved in such scams.

Now all Marriages shall be registered in a Sub Registrar's office to get Marriage Certificates.

If a Marriage Certificate is issued by the respective authority that is the end.

I have not understood as to which marriage certificate you signed and where?

If the marriage solemnization is not done in a Sub Registrar's office and if they have not issued authenticated Marriage Certificate with office seal and signature, then it cannot be considered as a marriage certificate.

In any way, it is better to consult an Advocate before taking any decision in this regard.

Engagement contracts are not legal in the United States, and such an agreement entered in to in India is not enforceable when you return to the U.S.





As for the wedding, if you have a marriage that is legally recognized in India (wedding ceremony or not,) then it is also legally recognized in the United States under most circumstances.
